{"id":914,"date":"2025-10-09T19:02:16","date_gmt":"2025-10-09T19:02:16","guid":{"rendered":"https:\/\/john-shirley.com\/blog\/?p=914"},"modified":"2025-10-09T19:02:16","modified_gmt":"2025-10-09T19:02:16","slug":"using-the-25th-amendment-not-so-easy","status":"publish","type":"post","link":"https:\/\/john-shirley.com\/blog\/using-the-25th-amendment-not-so-easy\/","title":{"rendered":"Using the 25th Amendment &#8211; Not So Easy"},"content":{"rendered":"<p>Can a president be removed from office against their will with the 25th Amendment?<\/p>\n<p>Section 4 of the 25th Amendment\u2014perhaps the most complex part of the amendment, which has never been invoked\u2014allows for the vice president and a majority of cabinet secretaries (or another body as Congress may provide) to declare the president unable to discharge the powers and duties of the office. The vice president then immediately assumes the role of acting president.<\/p>\n<p>If the president chooses to contest this declaration, Congress must then assemble to decide the issue within 48 hours (during which the vice president continues to serve as acting president). If two-thirds of both houses of Congress agree that the president is unable to perform their duties, the vice president continues as acting president; otherwise, the president resumes their duties.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Can a president be removed from office against their will with the 25th Amendment?
